What Mobile Home Owners Can Do

Mobile home owners facing rent hikes or otherwise caught in a tough position are urged to read the rent notices carefully, familiarize themselves with the law and consider their options. In Vermont, for example, mobile home residents can seek mediation from the state for rent hikes above a certain level, according to a website run by Vermont Legal Services and Vermont Legal Aid.

In North Carolinas Robeson County, James Lesane said he faced a dramatic rent increase on his mobile home lot earlier this year that he said was impossible to pay on a fixed income. The rent increase came after the mobile home park was bought by the Florida-based company Time Out, which says on its website that it owns more than two-dozen properties in North Carolina and Illinois.

In July, Lesane was hit with an eviction notice. Mueller, the Legal Aid lawyer representing Lesane, said theyre arguing in court that Time Out made mistakes in its paperwork and the case is moving slowly. Meanwhile, she said, Lesane and another client of hers served with an eviction notice are trying to save money to move to another park.

Time Out said in a statement that it invested millions to make its communities clean and safe. The rent rates were woefully behind true market valuations, they said, meaning mobile home parks lacked the funds to maintain the communities and many fell into disrepair.

    More than a year ago, Aurora was blazing trails in how to handle the battle between mobile home park owners and helpless renters.

    Now, Aurora lawmakers, like so many across the state, are struggling again with whether and how to preserve the dwindling stock of affordable housing.

    When Aurora City Council members approved a 10-month moratorium on redeveloping mobile home parks in the city along with a task force to study the housing stock, the effort was lauded as a forward-thinking. Leaders, academics and residents were hopeful that it would prevent the depletion of the region’s most affordable, non-subsidized housing option.

    “This move on Aurora’s part is incredible. I haven’t seen this happen anywhere. So this is a huge move,” Esther Sullivan, an assistant professor at the University of Colorado Denver who studies the role of mobile home parks, told the Sentinel after the passage. “They could be a model for the country here. Affordable housing advocates have to focus on preservation.”

    The eminent closure of the Denver Meadows Mobile Home Park, located on a swath of land north or East Colfax Ave., motivated council members to approve the moratorium and task force in March 2018, though the body was quick to point out both approvals were more far-reaching than Denver Meadows.

    Brian Arnold, who sat on the mobile home task force, said he’s already seen the success of the task force despite no city ordinances have come from the recommendations.

    What States Are Doing

    Colorado, where lawmakers estimate 100,000 people live in mobile homes in approximately 900 parks, enacted legislation this year to expand protections for mobile home residents, including more time to sell their home or move after eviction and longer to resolve late payments.

    Over the last several years, serious concerns have been raised by Colorados mobile home owners over mistreatment from park owners, bill sponsor Rep. Edie Hooton, D-Boulder, said in a statement when the bill was signed by the governor in May. This bill will give more tools to help protect Coloradans who are being exploited by relatively loose regulatory structures.

    Washington, which has longstanding law governing mobile homes, also made changes this year to expand situations in which residents are eligible for relocation assistance.

    Arizona has also enacted legislation in recent years to govern mobile home lots.

    Law To Help Mobile Home Owners Buy Their Parks Hits Snags

    DENVER A new Colorado law designed to give mobile home owners the chance to buy the land on which their homes sit has been largely unsuccessful.

    The Denver Post reports that more than a year after the new legislation took effect, there are few examples of residents buying their own parks.

    Of the 48 mobile home parks sold since the state began tracking sales last year, just two have been purchased by the parks own residents.

    Residents say park owners are sometimes skirting the law or otherwise taking advantage of vague language to avoid giving adequate notices of sale to homeowners and state regulators. Or they are negotiating in bad faith.

    Denver actively discourages mobile home parks within its boundaries.

    Trailer parks are officially a non-conforming use in Denver, and park owners cant add new homes or replace old ones. City officials arent entirely sure how many parks are left in the city, but its somewhere in the single digits.

    Denver Zoning Administrator Tina Axelrad said that even in 1956, when the zoning code first addressed mobile home parks, they were discouraged. Most of the parks in Denver got that way through annexations and are part of what Axelrad calls a county land-use pattern that isnt appropriate in a more urban area.

    The issue isnt the housing itself the zoning code doesnt really distinguish between manufactured housing and site-built housing but the layout of the parks, with small homes close together on narrow streets that are challenging for emergency vehicles to navigate, Axelrad said.

    So city policy has been that mobile home parks would go away over time. The city codified what had been an unspoken policy in 2014 at the same time officials were debating the fate of Belmont and Shady Nook.

    The people of the districts where most of these are felt that, weighing out the pros and cons, they would rather see the land turned over with public support into something better in their eyes and of a quality that was more beneficial to their community, Axelrad said.

    Boulder takes the opposite approach with a zoning policy that protects mobile home parks.

    Mobile home parks provide some of the last affordable housing in one of the most expensive cities in the Front Range, and land values are so high that owners would have a big incentive to sell if these sites could be rezoned. For that reason, Boulder has adopted a policy of not rezoning mobile home parks. And the city actually bought one mobile home park in central Boulder, the Mapleton Mobile Home Park, and converted it to a resident-managed community owned by Thistle Communities, a developer and manager of affordable housing. Boulder is poised to buy and annex another park on the citys northern edge, the Ponderosa Mobile Home Park.

    The purchase of Mapleton came about because the city needed some of the land for a flood control project. The city then turned the land over to Thistle because it didnt want to be in the park management business. Rather than redevelop the property as some other sort of affordable housing, it has remained a mobile home park.

    In Adams County, north of Denver, there are roughly 11,000 mobile homes in more than 70 parks.

    Back in 2000, there were more than 13,000 units, and mobile homes made up 10 percent of the housing stock. Now its just 7 percent. The Balanced Housing Plan from 2009 singles out this option as important to maintaining affordable housing in the county.

    Residents had begun talking about purchasing the park themselves to become a resident-owned community, and had heard no rumblings of an impending sale, so the news triggered concern especially when residents looked closer at page after page of new rules and regulations that the owners planned to impose, a list one resident figured would immediately put virtually everyone in violation of something.

    If residents didnt comply in a timely manner, the new rules allowed for management to perform improvements on residents property and send them the bill.

    I did not sleep that night, Ottero recalled.

    Anxiety spread quickly. It wasnt calmed by a subsequent meeting to announce rent increases and a plan to install new water meters and charge for water separately. And residents still had a tough time with what they felt were draconian rules 11 pages of them whereas the old ownership had just three.

    It took away the most important thing in the world to me, she says.
